Layered legal framework. The public 4SI policies govern the website and company relationship. The notices below add product-specific boundaries for Presence, including camera, biometric, AI, storage and acceptable-use disclosures. Contracted deployments may add customer-specific terms.
01 / BETA TERMS OF SERVICE
Terms for access and evaluation.
1. Agreement and operator
These Beta Terms govern access to Presence, the private beta environment operated by For Safety Group Inc., doing business as 4SI (“4SI,” “we,” “us”). By affirmatively accepting these Terms or using an account issued subject to them, you agree to be bound by them. If you use the Beta for an organization, you represent that you have authority to bind it. If you do not agree, do not use the Beta.
2. Beta purpose and eligibility
The Beta is a pre-production evaluation environment for product demonstration, research, partner review and controlled testing. You must be at least 18 and legally capable of entering this agreement. The Beta is not intended for children, emergency use, safety-of-life operation, production access control, regulated identity proofing or reliance in a consequential decision.
3. No production verification
Animations, status labels, local records, camera capture sets and assistant responses are not production authentication, biometric identification, authenticity findings, security certifications or legal determinations. “Capture ready” means only that a local multi-view image set was completed; you must not represent Beta output as verified evidence.
4. Account and access security
You are responsible for activity under credentials assigned to you, for protecting them, and for promptly reporting suspected compromise. Access is personal, revocable and limited to the authorized evaluation purpose. You may not share access, bypass controls, probe other tenants or attempt to extract protected mechanisms.
5. Acceptable use
You must comply with the Acceptable Use Policy below. You may submit only information you have the right to use. Do not submit special-category, biometric, health, financial, government-identifier, export-controlled, classified or other highly sensitive data unless 4SI has expressly authorized a production-grade environment and written data terms.
6. Intellectual property and feedback
4SI and its licensors retain all rights in the Beta, branding, interfaces, documentation, models, methods and protected mechanisms. No license is granted except a limited, revocable, non-transferable right to evaluate the Beta. You retain rights in your lawful input. You grant 4SI permission to process it only to provide and secure the Beta. Voluntary feedback may be used without restriction or payment, but 4SI does not obtain ownership of your pre-existing IP.
7. Confidentiality
Non-public Beta features, documentation, technical information and access materials are 4SI Confidential Information unless 4SI authorizes disclosure in writing. Protect them with reasonable care and use them only for the evaluation. This section does not cover information independently developed, lawfully received without duty, or publicly available without breach.
8. Availability, changes and suspension
We may change, limit, suspend or discontinue Beta features at any time. We may suspend access to protect users, systems, rights or legal compliance. Beta data may be reset. We will use reasonable efforts to provide notice when practical, but no service level applies unless agreed in writing.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BETA IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY OR SECURITY. Nothing excludes a warranty that cannot legally be excluded.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4SI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION ARISING FROM THE BETA. 4SI’S AGGREGATE BETA LIABILITY WILL NOT EXCEED US$100. These limits do not apply to liability that cannot lawfully be limited, including liability for fraud or willful misconduct where applicable.
11. Termination and effect
You may stop using the Beta at any time. 4SI may terminate Beta access for convenience or breach. On termination, your access ends and you must stop using Confidential Information. Provisions that by their nature should survive—including IP, confidentiality, disclaimers, limits and dispute terms—will survive.
12. Governing law and venue
Arizona law governs these Terms without regard to conflicts principles. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any court with jurisdiction. Mandatory consumer protections in your residence remain unaffected.
13. Contact and changes

What 4SI collects and why.
Controller
For Safety Group Inc. is the controller of personal data processed for the Presence Private Beta, except where an enterprise customer acts as controller and 4SI acts as its processor under a separate data processing agreement.
Data categories
Depending on enabled features, we may process account and contact data; organization, role and entitlement data; authentication and security events; Key and device references; user-entered object, scan and order metadata; support communications; technical logs such as IP address, browser, device, timestamps and diagnostics; preferences and browser-storage identifiers; and chat prompts and responses submitted to Aster. Scan Studio first stores user-initiated object viewpoints in IndexedDB on the current device. In a connected environment, an explicit private-reconstruction action uploads those viewpoints to a restricted quarantine store and may derive encrypted object geometry and a prototype descriptor. It does not intentionally create a human biometric identifier.
Purposes and legal bases
We process data to provide and secure the Beta; authenticate and administer access; operate requested workflows; respond to support; prevent abuse; maintain auditability; comply with law; and improve the Beta using appropriately limited data. For EEA/UK users, legal bases may include contract, legitimate interests in secure service operation and evaluation, legal obligation, and consent where required for optional storage, camera access, AI processing or future biometric enrollment.
Sources
Data comes from you, your organization, the browser or device you use, authorized integration partners, and security systems. We do not purchase biometric identifiers or infer them from public images.
Recipients and disclosures
We may disclose data to vetted hosting, security, support and AI service providers acting under contract; to your organization where it administers access; in a corporate transaction subject to appropriate safeguards; or when reasonably necessary to comply with law, protect rights or address security. We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
Aster AI processing
When an external model is configured, chat content is sent to that model provider to generate a response. The free Gemini tier may use submitted content to improve Google products under Google’s applicable terms. Do not enter sensitive or confidential information. A production deployment should use a paid or enterprise configuration with appropriate data terms, retention controls and a completed impact assessment.
Retention
Browser-local Beta records remain until you reset them or clear browser storage. Server-side security logs, if enabled, should be retained only for the documented security period, generally up to 90 days unless an incident, law or contract requires longer. Support and contractual records may be retained for the relationship plus applicable limitation and recordkeeping periods. Any future biometric identifier must follow a public retention schedule and be destroyed when its purpose is satisfied or earlier when required by law.
Security
We use risk-based administrative, technical and physical safeguards designed for the nature of the data. No system is perfectly secure. The Beta must not be used as the sole protection for a consequential system.
International transfers
4SI is based in the United States. Where EEA/UK data is transferred internationally, production service providers and contracts should use an approved transfer mechanism such as Standard Contractual Clauses and supplementary safeguards where required.
Children
The Beta is not directed to children under 13 and is not offered to anyone under 18. We do not knowingly collect children’s personal information. Contact us to request deletion if you believe a child provided information.
Changes and contact
We will date material changes and provide additional notice where required. Privacy requests may be sent to contact@by4si.com with “Privacy Request” in the subject line.
03 / NOTICE AT COLLECTION
Information visible at the moment it matters.
Before collecting personal information, 4SI should present a contextual notice identifying the categories collected, purposes, retention approach and a link to this Privacy Notice.
Account and identifiers: to provide and secure access; retained for the account relationship and required records.
Device, session and network data: to authenticate, prevent abuse and troubleshoot; normally up to 90 days unless required longer.
Key, object and capture metadata: to perform the requested Beta workflow; browser-local in the current Beta.
Support and chat content: to answer requests and improve support; do not provide sensitive information.
Sensitive information: not requested in the public Beta. Future biometric processing requires a separate, explicit notice and consent where required.
4SI does not sell these categories or share them for cross-context behavioral advertising. See Privacy Rights below for request methods.
04 / CAMERA & BIOMETRIC NOTICE
Camera access is not hidden consent.
The Beta requests camera permission only after the user configures an object and chooses to continue. The browser controls the permission. Scan Studio analyzes light, sharpness, stability and viewpoint change locally and stores explicitly captured object images in IndexedDB until the user deletes the object or clears browser data. No upload occurs unless the user explicitly chooses private reconstruction in a connected environment. That action sends the selected object frames to restricted quarantine storage, where integrity is checked and a worker may create temporary geometry and an encrypted prototype object descriptor under the displayed retention period. A reconstruction is not an authenticity decision. Users must not capture people, confidential material or objects they are not authorized to process.
4SI does not intend this workflow to create a faceprint, fingerprint, iris template, voiceprint or other human biometric identifier. Before any production biometric enrollment, identification or persistent object-derived authentication descriptor, 4SI must provide a separate written notice describing the specific identifier, purpose, recipients, retention and destruction schedule; obtain written or otherwise legally valid consent where required; prohibit sale or unauthorized disclosure; protect the data using a standard at least as protective as other confidential information; and support withdrawal and deletion where required. Illinois, Texas, Washington and other jurisdictions impose distinct biometric requirements. A customer may not enable such processing without a completed legal review and required consent records.
05 / AI TRANSPARENCY NOTICE
Aster is an AI guide—not an authority.
Aster is clearly identified as AI-assisted. It provides explanations and navigation based on a bounded 4SI knowledge base. If an external LLM is configured, the response may be generated by that provider and may be inaccurate. Aster does not authenticate people or objects, make access decisions, provide professional advice or replace human review.
Users should not enter secrets, biometric data, government IDs, health data, payment data, confidential evidence or other sensitive information. 4SI should maintain provider due diligence, prompt/output safeguards, monitoring, an incident path and a documented privacy and AI impact assessment before production use.
06 / COOKIES & LOCAL STORAGE
Minimal storage, explained plainly.
The current Beta uses localStorage to remember Beta account edits, settings and lightweight records, and IndexedDB to retain Scan Studio object records and image viewpoints created in that browser. This is functionally necessary for the requested experience. Scan objects can be deleted inside Scan Studio; all local data can also be removed with browser controls. The Beta is not designed to use advertising cookies or cross-site tracking.
If analytics, personalization or marketing technologies are added, 4SI must update this notice, classify vendors, honor applicable consent and opt-out signals, and deploy a consent mechanism before non-essential technologies run where required.
07 / ACCEPTABLE USE POLICY
Use the Beta without weakening the boundary.
You may not: violate law or another person’s rights; attempt unauthorized access; probe, scan or test systems without written authorization; interfere with service; distribute malware; reverse engineer protected mechanisms except where law expressly permits; scrape or bulk extract data; impersonate another person; submit unlawful or sensitive data without authority; use Beta output as production proof; train competing models on protected content; evade rate limits; or use 4SI for weapons, surveillance abuse, unlawful discrimination or a consequential decision without authorized production controls and human accountability.
Good-faith security research must follow the Security & Responsible Disclosure section. 4SI may investigate and suspend activity reasonably believed to threaten users, systems or rights.
08 / SECURITY & RESPONSIBLE DISCLOSURE
Report risk without creating more of it.
Send suspected vulnerabilities to contact@by4si.com with “Security Report” in the subject. Include affected URL or component, impact, reproducible steps and a safe proof of concept. Do not access other users’ data, degrade service, use social engineering, perform denial-of-service testing, publish secrets or retain data beyond what is necessary to report.
4SI should acknowledge valid reports, coordinate remediation and provide a disclosure timeline when appropriate. This policy does not authorize activity that violates law or third-party terms and is not a promise of reward. For urgent active compromise, state “URGENT SECURITY” in the subject line.
09 / PRIVACY RIGHTS
Access, correction, deletion and control.
Depending on residence and applicable law, individuals may request access, correction, deletion, portability, restriction or objection; withdraw consent; opt out of sale, sharing, targeted advertising or certain automated decisions; limit certain sensitive-data uses; and appeal a denied request. 4SI does not discriminate for exercising privacy rights.
Submit a request to contact@by4si.com with “Privacy Request,” your state or country, the right requested and enough information to locate the relevant account. We may verify identity proportionately and may deny or limit requests where law permits. Authorized agents must provide proof of authority. EEA/UK individuals may complain to their local supervisory authority; US residents may contact their state regulator. California users may also use recognized opt-out preference signals where applicable.
